Facilitates Harmful or Offensive Content
Posting, storing, distributing, or transmitting content that is unlawful, libelous, harassing, fraudulent, defamatory, abusive, threatening, harmful, hateful, obscene, or otherwise objectionable (including content that promotes or depicts sexual exploitation, racism, bigotry, hatred, or physical harm).
Promotes Illegal or Harmful Activities
Promoting or depicting activities that encourage violence, self-harm, illegal drug use, underage drinking, gambling (where prohibited), or other activities that are contrary to applicable laws or regulations.
Compromises Network Security
Using the Services to breach or attempt to breach the security of our systems or any third party’s network or system (e.g., hacking, scanning, or testing the vulnerability of servers).
Introducing or transmitting viruses, worms, Trojan horses, spyware, adware, keyloggers, or any other malicious software intended to disrupt, damage, or gain unauthorized access to systems or data.
Engages in Unsolicited Activities
Sending or facilitating the distribution of unsolicited or unlawful mass email (spam), junk mail, chain letters, or any other form of unauthorized solicitation.
Harvesting or collecting email addresses, personal data, or other information about users without their explicit consent or in breach of applicable data privacy laws.
Misrepresents Identity or Affiliations
Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity (e.g., phishing, pharming, or other fraudulent practices).
Violates System Integrity
Using any automated means (e.g., bots, scrapers) to access or use the Services in a manner that sends more requests to our servers than a human can reasonably produce in the same period, or in a manner that disrupts the normal functioning of our Services.
Other Unacceptable Conduct
Engaging in any behavior that, in our sole discretion, poses or creates a risk of harm to Ultra Commerce, our customers, users, partners, or the public.
3. User Responsibilities
3.1 Compliance with Laws
You must comply with all applicable laws and regulations when using our Services. This includes adherence to export control laws, data protection and privacy regulations, and all other relevant statutes in your jurisdiction.
3.2 Reporting Violations
If you become aware of any violations of this AUP or believe the Services are being used inappropriately, you agree to immediately notify Ultra Commerce via the Contact Information contained in Section 8.
3.3 Account Security
You are responsible for maintaining the confidentiality of any login credentials (e.g., usernames, passwords, API keys). You must promptly notify us of any unauthorized use of your account or any other breach of security.
4. Monitoring and Enforcement
4.1 Right to Monitor
Ultra Commerce may, but is not obligated to, monitor your use of the Services to ensure compliance with this AUP and applicable laws. We may investigate any potential violation and remove or disable access to any user content or account if we believe a violation has occurred.
4.2 Enforcement Actions
We may take any action we deem appropriate, including but not limited to:
Issuing a warning.
Restricting, suspending, or terminating your access to the Services.
Removing or disabling access to any content that violates this AUP.
Reporting you to law enforcement, regulatory authorities, or other appropriate third parties where your conduct suggests a risk of unlawful behavior.
4.3 Cooperation with Authorities
We will fully cooperate with law enforcement, regulatory agencies, or court orders requesting or directing us to disclose the identity of anyone using the Services for illegal activity.
5. Intellectual Property Rights
5.1 Our Rights
All rights, title, and interest in and to the Services and any related intellectual property are owned or licensed by Ultra Commerce.
5.2 Your Rights
You retain all rights in the content you upload or submit to our Services, provided it does not infringe third-party rights or violate this AUP.
